GENERAL CONTRACTING CONDITIONS

The following General Conditions of Contract, hereinafter the "Conditions" regulate the contractual relationship between the company HISPA IMPORTACIONES DELUXE SL provided with CIF B57779423 and with registered office at Calle Duque de Sesto 13, 28009, Madrid (Spain) and the user who purchases the products and/or services through the website www.espiamos.com (hereinafter, website) owned by HISPA IMPORTACIONES DELUXE SLU (hereinafter, company).

HISPA informs you that the following terms and conditions are also permanently available to users on the aforementioned website. We recommend reading this document, downloading it, and printing it for safekeeping.

I.- General Aspects.

The general conditions are written in Spanish and are governed primarily by, among others, Law 34/2002, of July 11, on Information Society Services and Electronic Commerce and, where applicable, by Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.

Only persons over 18 years of age may enter into contracts, acting on their own behalf and rights or, where applicable, on behalf of a legal entity with legal representation. By accepting these terms and conditions, you declare that you are of legal age.

II.- Purpose.

The purpose of this contract is the online purchase of products and services through the website, intended solely for professionals in the private investigation sector and individuals for business and parental control purposes.

Not every user who makes a contract through the website is considered a consumer. For these purposes , consumers shall be understood only as natural persons acting for a purpose unrelated to their commercial, business, trade, or professional activity, and legal persons and entities without legal personality acting on a non-profit basis in a field unrelated to a commercial or business activity.

Conducting e-commerce through the website implies acceptance of these general terms and conditions.

The company expressly prohibits the purchase and acquisition of any of its products for the purpose of committing acts that could constitute a civil offense and/or a crime. The company will not be liable for the improper use of products purchased at www.espiamos.com or for any interference with privacy or confidentiality of communications that may occur.

III.- Order.

Orders can be placed online through the website or by phone or email.

Orders are processed Monday through Friday from 9:00 a.m. to 4:00 p.m. Orders placed after 4:00 p.m. on Fridays will be processed the next business day.

To purchase any of the products and/or services offered, users can purchase directly by clicking on the icon of the product(s) of interest. Once added to their shopping cart, they can continue shopping by completing the same process.

Once the product selection is complete, the purchase process will begin. The user must complete the personal information form to register as a customer and enable delivery of their order. Customer registration means that your personal information is stored, so you won't need to complete it again for subsequent purchases.

After your order is automatically validated and you expressly accept these terms and conditions and the Privacy Policy, you will receive an email confirming that your order has been registered.

HISPA informs you that it will archive the electronic document formalizing your order. Furthermore, contractual information will be provided to you prior to receiving the purchased products so that, if necessary, you can correct any incorrect information appearing in your order. The company also informs you that once the order has been placed and shipped, you may not modify your purchase without prejudice to your right of withdrawal.

The invoice will be sent to you in paper format along with your order upon delivery.

IV.- Prices, Best Price Guarantee and Payment Methods.

The prices of the products and/or services specified on the website include Value Added Tax (VAT). Discounts and promotions on the website apply only to online sales. Prices in physical stores may vary.

Additionally, we offer a Best Price Guarantee, subject to the following conditions: This guarantee applies exclusively to products from the brands LawMate, Secureee, Digiscan Labs, JJN Digital, Sun Mechatronics, Stealth Tronic, Sekotech, Selcom, and TS Market. These products must be located within the European Union, as products outside the EU do not include tariffs. This guarantee does not apply to brands with exclusive territorial distribution. To validate this guarantee, a product URL and a quote from the competing company must be provided.

We reserve the right to change product prices at any time. However, products will be billed at the rates in effect at the time of order confirmation, subject to availability.

Payments can be made in euros using the following methods: cash on delivery, bank card (Visa, Visa Electron, MasterCard, credit and/or debit) via a secure payment gateway on a server protected with the SSL (Secure Socket Layer) protocol, or bank transfer. Additional fees may apply for cash on delivery payments.

The customer guarantees that he/she is authorized to use the selected payment method.

V.- Costs and Delivery Service.

The package will be delivered to the address designated at the time of the order or, if applicable, to the carrier's designated branch or the post office closest to the address, depending on the delivery company, if requested by the user.

Shipping costs will be borne by the user according to the rates indicated below.

In-stock items will be processed and shipped within 24 business hours of receiving payment.

Upon receiving your order, you must check the packaging for damage. If so, you must notify the shipping company within 24 hours so they can take responsibility for any damage. Shipments are not insured. If you wish to purchase damage insurance, you must contact Hispa in advance for a quote.

VI.- Return and Warranty Policy.

HISPA IMPORTACIONES DELUXE informs you that when returning products purchased through the website, it is important to take into account the following considerations:

1st.- It is ESSENTIAL that the user keeps the original packaging, the product invoice and that the product is in perfect condition.

2.- Product exchanges will not be accepted, nor will refunds be issued if the product shows signs of use, is incomplete, or has been tampered with. The only permitted use for accepting a return is to simply check the condition and operation of the device.

3. Under no circumstances will we accept packages sent to our warehouse freight collect. We recommend sending them by registered letter, insuring the merchandise to prevent damage or loss.

5.- It is absolutely mandatory to present proof of purchase for returns and warranty processing.

6.- Before proceeding with any shipment, contact HISPA IMPORTACIONES DELUXE through the Customer Service Center by calling +34 911 574 581 or by emailing ventas@espiamos.com so we can give you the corresponding instructions.

  • Instructions for repairing products under warranty:

Repairs and replacements will be free of charge to the consumer or user provided the product is under warranty and it can be proven that the problem is due to a defect in the original manufacturing process. This free service will include the necessary expenses incurred to remedy the lack of conformity of the products with the contract, such as shipping costs, labor costs, and materials only when the customer is an end consumer.

Technical Service will send you an RMA, which must be submitted with the product signed by the customer. Once the merchandise has been received at our warehouses and its condition has been verified, the company will review it and determine whether the product is covered by the warranty. If the product is due to a malfunction covered by the warranty, HISPA IMPORTACIONES will exchange it for another product of equal or greater value. If the product is out of stock, a product with similar or superior characteristics will be offered if the customer so desires, paying the difference in price with respect to the higher value.

In the event that the return of the product is due to any other cause, the refund amount will be reduced by all expenses incurred in shipping the product (courier service, cash on delivery) as well as 5% corresponding to management costs (transfer fee or POS refund fee).

Withdrawal :

The return of products purchased through the website as well as, where applicable, the right to withdraw from the purchase of products on the website will only be granted if the buyer has the status of consumer and provided that the nature of the purchased good allows it,

In accordance with Royal Decree-Law 1/2007, of March 27, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, the consumer may withdraw from the purchase within 14 calendar days of receiving the product, in accordance with the provisions of the following section. Depending on the case, the company reserves the right to issue a voucher for the same amount to be redeemed on our website. This voucher will not expire.

If the consumer exercises the right to withdraw in accordance with these terms and conditions and consumer regulations, HISPA IMPORTACIONES DELUXE will refund the purchase price in the same manner in which it was paid and within a maximum period of 14 days from receipt of the product.

HISPA IMPORTACIONES DELUXE informs that all costs and risks associated with the return of products will be borne by the user/consumer in accordance with article 108 of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.

Without prejudice to the foregoing, HISPA IMPORTACIONES DELUXE informs you that in any case the exercise of the Right of Withdrawal is exempt in the following cases:

  • Contracts for the supply of products made according to the consumer's specifications or clearly personalized, or which, by their nature, cannot be returned or may deteriorate or expire quickly.
  • Contract for the supply of sealed goods that are not suitable for return due to health protection or hygiene reasons and that have been unsealed after delivery.
  • Contracts for the supply of sound or video recordings, discs, and computer programs that have been unsealed by the consumer and user after delivery, as well as computer files supplied electronically and capable of immediate download or reproduction for permanent use.
  • The supply of digital content that is not provided on a physical medium when the execution has begun with the prior express consent of the consumer and user with the knowledge on their part that they consequently lose the right of withdrawal
  • Any type of software.
  • Products that have been manipulated or customized.

 3 Year Warranty Policy.

The company informs that when purchases are made by companies and/or professionals for the development of their activity, the warranty on the products sold on the website will be subject to a maximum period of 6 months from the delivery of the product, without prejudice to the provisions applicable by the Commercial Code and Civil Code.

Starting July 11, 2024, a three-year warranty is offered for products purchased through the website. This warranty applies only to end consumers.

In accordance with the terms established in Royal Decree 1/2007, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, the company will respond to any lack of conformity that becomes apparent within three years of delivery of the product. If, after six months from delivery of the product, the consumer notes a lack of conformity, it will be their responsibility to prove that such lack already existed at the time of purchase.

It is important to note that the warranty will not apply in the following circumstances:

  • When the lack of conformity is due to defects and/or deterioration caused by force majeure.
  • In case of installation and/or use of the product not in accordance with the instructions for use and maintenance provided.
  • The warranty does not include the batteries in the products.

This three-year warranty reflects our commitment to the quality of our products and the service we provide to our customers.

VII.- Comments.

The company allows users to post comments and reviews about the products and services offered on the website. By posting a comment, the user agrees that its content may be public and accessible to other users.

Comments must be based on real experiences with products purchased from ESPIAMOS and must not contain false, defamatory, misleading, or information that violates the rights of third parties. Comments with offensive, discriminatory, or regulatory content will not be allowed.

The company reserves the right to moderate, edit, or delete comments that do not comply with these conditions without prior notice. Likewise, comments that include personal information of third parties may be denied publication without their express consent, in compliance with data protection regulations.

The company is not responsible for the opinions expressed by users in comments, except in cases where it has actual knowledge of their illegality and fails to remove them. If a user detects a comment that violates these rules, they can report it via email to ventas@espiamos.com for review.

By submitting a comment, the user grants the company a non-exclusive, free, and unlimited territorial license to use it for commercial purposes, including its reproduction in other digital or print media.

VIII.- Applicable legislation.

Any dispute that may arise from the use of this website, the parties submit to the jurisdiction and competence of the Courts and Tribunals of Alicante city, waiving their own jurisdiction except where Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, applies.

Likewise, HISPA IMPORTACIONES DELUXE informs the consumer of its willingness to join the Online Dispute Resolution platform for any dispute that may arise in consumer matters from the moment that Spain has conflict resolution bodies in accordance with the provisions of article 14.2 of Regulation (EU) 524/2013, which is available at the following link: https://ec.europa.eu/consumers/odr/ . HISPA IMPORTACIONES DELUXE will not be liable for any anomalies in the operation of this platform.

IX.- Other considerations .

HISPA IMPORTACIONES DELUXE reserves the right to modify these General Conditions at any time without prejudice to the user and respecting, where applicable, the conditions in force at any given time.
